{"id":2396,"date":"2013-01-14T03:02:31","date_gmt":"2013-01-14T10:02:31","guid":{"rendered":"http:\/\/melacey.com\/blog\/?p=2396"},"modified":"2013-01-14T03:02:58","modified_gmt":"2013-01-14T10:02:58","slug":"tatels-case","status":"publish","type":"post","link":"https:\/\/melacey.com\/blog\/books\/tatels-case\/","title":{"rendered":"Tatel&#8217;s Case"},"content":{"rendered":"<p>Finding out that I was a publisher, \u00a0Sto:lo\u00a0Indian, Kwitsel Tatel (Halqe\u2019meylem for &#8220;grizzly bear mother&#8221;)\u00a0approached me and asked if I would take information that she created and researched for presentation in a Chilliwack Court. She wanted to create a publication for use in an upcoming court presentation on Jan. 14, 2013.<\/p>\n<p>She informed me of the following:<\/p>\n<p>On Wednesday, July 14, 2004, she, a Federal Indian living in the Fraser Valley, possessed 396 sockeye salmon, earmarked for a Sto:lo cultural family gathering. BC&#8217;s Department of Fisheries and\u00a0Oceans (DFO) seized her 396 fish and advised her that\u00a0they were going to investigate the possibility of charging her.\u00a0On July 15, 2004, DFO sold 296 \u00a0fish.\u00a0DFO charged her with possession of fish on July\u00a03, 2008; that same day, she was found guilty in a BC provincial\u00a0court by Chief Justice of BC, his Honour Judge\u00a0Thomas Crabtree.<\/p>\n<p>In an 8-year and counting trial (47476), now extending to nearly 200 days of court time, on\u00a0Jan. 14,\u00a0Tatel intends to defend all Aboriginal rights in a \u201cPhase\u00a02\u201d (Stage 2) of the same case in the same court. In doing so, Tatel plans to present a substantive letter \u00a0to Judge Crabtree\u00a0in defence of Section 35 of \u00a0Canada\u2019s Constitution Act, 1982.<\/p>\n<p>The 150-page, 5.5&#8243; x 8.5&#8243; unpublished, but printed,\u00a0book includes her letter to Judge Crabtree, maps, an analysis and preface to her &#8220;grandfather&#8221; Dan George&#8217;s Centennial speech by University of Lethbridge\u00a0professor (globalization studies in the department of Native American Studies), Anthony Hall and Dan George&#8217;s Centennial speech.<\/p>\n<p>(Dan George was the head of the family that adopted Kwitsel\u00a0Tatel after she was orphaned at the age of 13 years, with the death of\u00a0her mother.
